Mark J. Goldsmith

Mark J. Goldsmith is a partner at Baird Holm LLP, practicing in the Labor & Employment section. He represents employers in complex employment litigation and arbitration, particularly defending against claims involving discrimination, retaliation, and wrongful termination under federal and state laws, including Title VII, ADA, ADEA, and FMLA.

Mark earned his Juris Doctor from Washington and Lee University School of Law in 2006 and holds a Bachelor of Arts degree from the University of California, Los Angeles. He is licensed to practice in California, Nebraska, Iowa, and Kansas and is admitted to numerous U.S. District and Circuit Courts across the country.

Mark brings over a decade of litigation experience from California, where he handled employment, trade secret, and professional liability cases. He provides counsel to businesses with California operations on separation agreements, regulatory compliance, and administrative proceedings, including those before the Labor Commissioner and the Department of Fair Employment and Housing.

Mark is an experienced employment litigator who defends employers in high‑stakes disputes. He has won jury trials, secured summary judgment in workplace discrimination and harassment cases, and obtained favorable appellate decisions, including before the Eighth Circuit. With deep experience in both trial and appellate courts, Mark delivers strategic, results‑driven defense for employers facing complex employment law claims.

Mark is a Fellow of the American Board of Trial Advocates and has been named a “Rising Star” by Super Lawyers® multiple times. He is also a graduate of the Nebraska State Bar Association Leadership Academy and is actively involved in professional legal communities committed to excellence in advocacy.
