Daniel J. Auerbach is a Shareholder at Browning Kaleczyc Berry & Hoven P.C and Chair of the firm’s Healthcare Law Practice Group. His practice covers healthcare law, insurance defense, commercial transactions, business law, employment defense and counseling, captive insurance, intellectual property, and class action litigation. He advises healthcare providers on regulatory compliance, risk management, privacy, provider contracting, reimbursement issues, employment claims, clinic formation, and operational needs across varied care models and settings.

Daniel earned his J.D. from the University of Oregon, where he completed a business concentration, and his M.B.A. in Sports Business and Marketing through a concurrent degree program. He also earned his B.A. in History from the University of Oregon. During graduate study, he was admitted to the Warsaw Sports Marketing Center, a selective program focused on sports business, marketing, and finance. He joined BKBH in 2005 as an attorney.

Daniel represents healthcare providers in administrative proceedings and litigation involving HIPAA violations, malpractice claims, physician contract disputes, reimbursement claims, and Medicare and Medicaid fraud, including Stark Law and Anti-Kickback compliance. His insurance defense work includes professional liability, medical malpractice, products liability, trucking and automotive litigation, premises liability, claim management, and apportionment. He also handles arbitration and mediation and advises businesses on contracts, mergers, acquisitions, loans, governance, and operations for clients.

Daniel J. Auerbach also counsels employers on employment agreements, independent contractor agreements, handbooks, discipline, severance, reductions in force, discrimination, retaliation, wrongful discharge, unemployment benefits, and wage-and-hour disputes. His captive insurance work includes formation, licensing, redomestication, regulator coordination, and ongoing compliance. He also assists with state and federal trademark registration, intellectual property agreements, liquor licensing for food and beverage clients, and complex class action disputes involving corporate clients across diverse commercial matters.
