Daniel C. Herr is a respected employment and civil litigation attorney based in Wilmington, Delaware. He represents individuals and businesses in employment law, breach of contract, business disputes, and trade secret litigation. His practice covers non-competition, non-solicitation, confidentiality, and employee mobility matters. Daniel has successfully litigated several hundred cases in state and federal courts throughout Delaware and Pennsylvania and has taken 24 cases through trial, winning all but three.
Daniel earned his J.D. cum laude from Widener University School of Law (now Delaware Law School) with pro bono distinction and honors from the Institute of Delaware Corporate and Business Law. While at Widener, he served on the Editorial Board of the Widener Law Review and the Executive Board of the Moe Levine Trial Advocacy Honor Society.
Daniel also interned for Vice Chancellor Donald F. Parsons, Jr. of the Delaware Court of Chancery and Justice Henry duPont Ridgely of the Delaware Supreme Court. He clerked for Judge Mary Johnston of the Delaware Superior Court before entering private practice.
Daniel’s practice includes counseling on severance agreements, non-compete, non-solicitation, and non-disclosure agreements. He has secured millions in recoveries for plaintiffs and avoided millions in liability for defense clients. He represents clients locally in Wilmington and the Greater Philadelphia Area, and nationally and internationally when needed.
Recognized for his excellence, Daniel C. Herr has been named a Delaware Rising Star by Super Lawyers multiple times and a “Top 40 Under 40” trial attorney by The National Trial Lawyers Association. He is active with the Delaware State Bar Association, where he has served as Chair of its Employment and Labor Section, and is a frequent speaker and guest lecturer on employment law topics.
