Theodore Lothstein

Theodore Lothstein is a New Hampshire criminal defense lawyer at Lothstein Guerriero, PLLC, focused on DWI defense, criminal trials, appeals, and post-conviction matters. He has more than 30 years of experience and has handled high-profile cases reported by major regional and legal publications. His work includes representation in District Courts, Superior Courts, the New Hampshire Supreme Court, federal district court, and the First Circuit Court of Appeals in Boston, and related courtroom advocacy matters.

Theodore earned his J.D., summa cum laude, from the University of Connecticut School of Law in 1993 and his A.B. from Duke University in 1989. After law school, he clerked for former Associate Justice Robert Berdon of the Connecticut Supreme Court. He later served at the New Hampshire Public Defender as a trial attorney, litigation support attorney, and assistant appellate defender in criminal matters and complex appeals work.

Theodore has tried more than 30 criminal jury trials, many involving felony charges such as domestic violence allegations, drug distribution, burglary, first degree assault, aggravated felonious sexual assault, and first degree murder. He has also litigated more than 90 appeals in the New Hampshire Supreme Court and First Circuit Court of Appeals, including matters that created important precedents and drew national attention in criminal law across New Hampshire courts regularly.

Theodore Lothstein has also trained more than a thousand lawyers through seminars presented by the New Hampshire Bar Association, NHACDL, and the New Hampshire Public Defender. He taught criminal justice courses as an adjunct professor and trained law students on DWI defense. Theodore was named the 2024 Champion of Justice by NHACDL and holds a Martindale-Hubbell Preeminent Rating for professional skill and commitment to careful client advocacy statewide overall.
