Morgan Brekke is an attorney whose practice centers on health law and employment law. With a strong background in the health care industry, she works with a wide range of health care organizations on legal issues that affect their daily operations and long-term goals. Her experience includes advising hospitals, physician groups, ambulatory surgical centers, and other health care entities on important legal and regulatory matters. Through her work, she helps clients address challenges while reducing legal risk and supporting compliance with applicable laws.

Morgan earned a B.A. from the University of South Dakota and graduated Summa Cum Laude. She later received a J.D. from the University of South Dakota School of Law with Sterling Honors. During law school, she graduated first in her class and took on several leadership and academic roles. She served as president of the Moot Court Board, worked as a graduate assistant, and participated in the Trial Team, building a strong foundation for her legal career.

Morgan focuses much of her practice on health care law. She assists clients with state and federal regulatory compliance, licensing and accreditation matters, HIPAA compliance, and medical staff issues. She also reviews business arrangements and provides guidance designed to reduce risks related to laws such as the Stark Law and the Anti-Kickback Statute. In addition, she handles physician, vendor, and other health care contracts, helping organizations establish sound legal relationships.

Morgan also counsels employers on a broad range of workplace matters. Her employment law work includes guidance on hiring, discipline, termination, wage and hour requirements, employee testing policies, workplace discrimination and harassment concerns, disability accommodations, and FMLA leave issues. She prepares and reviews employee handbooks, employment agreements, workplace policies, and separation agreements to help organizations maintain effective employment practices.

Before entering private practice, Morgan gained valuable legal experience through judicial clerkships. She clerked for Chief Justice David E. Gilbertson of the South Dakota Supreme Court and for the Honorable Roger L. Wollman of the United States Court of Appeals for the Eighth Circuit. Her work has earned professional recognition, including being recognized by Best Lawyers: Ones to Watch in America in the specialty of Health Care Law in 2024. Drawing on years of experience in the health care field, she continues to help clients navigate complex legal issues with practical and thoughtful guidance.
