Mark Thomas Emery focuses on appellate advocacy and complex litigation strategy. He has prepared briefs and other filings in 20 cases before the US Supreme Court and has argued matters in many federal and state appellate courts. He also advises trial teams by shaping legal arguments and preserving issues for appeal.
Mark earned a BA from Michigan State University (James Madison College) in 1992. He later completed a Ph.D Yale University (Political Philosophy), 2000. He received his JD from Notre Dame Law School in 2005. During college, he was elected to Phi Beta Kappa and wrote a doctoral dissertation on Simone Weil.
Mark handles appeals across a wide range of industries, including energy, technology, life sciences, and healthcare. His work covers constitutional issues, employment disputes, patent matters, False Claims Act cases, and commercial conflicts. He often steps into active trial matters to refine arguments and guide overall appellate strategy.
Mark has achieved significant results in appellate courts nationwide. He has helped secure reversals of multimillion-dollar judgments, defended favorable jury verdicts, and obtained dismissals in complex class actions and statutory claims. His experience includes matters before the First, Fifth, Ninth, Eleventh, and D.C. Circuits, among others.
