Kimberly A. Berger

Kimberly A. Berger is a principal at Miller Canfield with a practice dedicated to intellectual property litigation and trademark prosecution. She represents a broad spectrum of clients—from international corporations to emerging businesses—in matters involving trademarks, copyrights, trade secrets, domain names, and unfair competition in both U.S. and global jurisdictions.

Kim earned her Bachelor of Arts from the University of Detroit-Mercy in 1996 and her Juris Doctor from Wayne State University Law School in 1999. She is admitted to the Michigan Bar and practices before the U.S. District Courts for the Eastern and Western Districts of Michigan.

Kim offers strategic counsel on trademark selection, clearance, and registration. She manages domestic and international trademark portfolios, handles oppositions and cancellations before the U.S. Patent and Trademark Office, and negotiates brand use agreements to protect and enforce clients’ intellectual property rights.

Kim’s litigation experience spans federal and state courts, covering trademark and copyright infringement, domain disputes, trade secret violations, and false advertising claims. She frequently advises clients on digital brand protection and e-commerce enforcement across industries, including retail, hospitality, automotive, higher education, and the craft beverage sector.
