Joseph H. Lemkin is a Shareholder at Stark & Stark, PC, and a member of the firm’s Bankruptcy & Creditors’ Rights Group. Joseph earned his Juris Doctor from Hofstra University School of Law in 1994, following his Bachelor of Arts from Rutgers College in 1990. His academic background supports a disciplined, analytical approach to insolvency, restructuring, and litigation matters involving financially distressed entities and creditors.
Joseph represents mortgage lenders, secured creditors, creditors’ committees, trade creditors, debtors, and bankruptcy trustees in a wide range of proceedings. His experience includes Chapter 7, Chapter 11, and Chapter 13 bankruptcies, assignments for the benefit of creditors, and bankruptcy-related litigation. He regularly handles adversary proceedings involving preference claims, fraudulent transfers, and other avoidance actions.
Joseph has served as national bankruptcy and litigation counsel for major financial institutions, including managing loan portfolios for healthcare providers, such as medical, dental, and veterinary practices. He also represents an international consumer products company as national bankruptcy counsel, handling high-profile matters pending in bankruptcy courts in New York and Delaware.
Prior to joining Stark & Stark, Joseph was the Chairman of the bankruptcy group at a New Jersey-based business law firm and previously served as a partner at the AmLaw 100 firm Duane Morris. His leadership roles reflect extensive experience with sophisticated restructuring and litigation matters.
