Jonathan M. Peake

Jonathan M. Peake is an Albuquerque criminal defense attorney with more than 18 years of experience in New Mexico criminal law. A former assistant district attorney, he defends people accused of DWI, drug offenses, violent crimes, domestic violence, theft, weapons charges, and sex crimes. His work spans serious felony allegations, including first-degree murder, as well as complex misdemeanors and probation violations. Jonathan approaches each case with an understanding of how prosecutors develop charges, assess evidence, and attempt to prove guilt in court.

Jonathan earned a Bachelor of Arts in English from Michigan State University, where he also minored in psychology. He later received his Juris Doctor from Thomas M. Cooley Law School. His background in language and communication shapes how he presents detailed criminal evidence and explains legal arguments to juries. Admitted to practice in New Mexico, he has built his career around criminal litigation, where a defense’s strength often depends on exposing gaps between an allegation and what the evidence establishes.

Jonathan began his career in 2006 as an assistant district attorney in Valencia and Bernalillo Counties, gaining firsthand experience prosecuting criminal cases, including DWI matters. He now applies that perspective to challenges involving evidence, procedural mistakes, and the government’s burden of proof. The criminal defense practice he leads at Peake Law Firm secured a trial acquittal on drive-by shooting allegations and the dismissal of an aggravated DWI case involving a collision with police vehicles on procedural grounds, both in March 2026.

Jonathan M. Peake is a former president of the Criminal Law Section of the State Bar of New Mexico. He also lectures at the University of New Mexico School of Law and teaches continuing legal education seminars for attorneys. In 2020, he established a practice devoted to expunging eligible criminal records, extending his work beyond defense in pending cases. Fluent in Spanish, he serves clients in English and Spanish, combining courtroom advocacy with work aimed at limiting the long-term consequences of criminal allegations and records.
