Erika Eaton Malmen is a partner and the Boise office managing partner at Ashurst Perkins Coie. She advises mining, industrial, agribusiness, energy, forestry, utility, resort, municipal, and development clients on environmental and natural resources matters. Her practice includes public lands permitting, regulatory compliance, real estate issues, water rights, and disputes involving federal and state environmental laws. Malmen also represents clients before administrative tribunals and in state and federal court litigation.
Malmen earned her J.D. from the University of Denver Sturm College of Law in 2000 and her B.S. in Speech Communication from the University of Utah in 1996. Her legal background includes serving as legal counsel to Idaho’s Office of Species Conservation and as an attorney with the U.S. Department of the Interior’s Office of the Solicitor. This government experience strengthens her understanding of agency decision making, environmental regulation, land management, and project permitting.
Malmen has advised clients on energy projects, mining claims, water and mineral rights, environmental due diligence, stormwater compliance, habitat conservation plans, transmission lines, and federal land use approvals. Her experience includes representing developers, utilities, industrial businesses, local governments, landowners, and resource companies. She works with agencies, engineers, and public relations professionals to address regulatory scrutiny, communicate project objectives, obtain permits, and manage litigation involving environmental statutes and administrative decisions.
Erika Eaton Malmen has been ranked by Chambers USA for environmental and natural resources law and listed in The Best Lawyers in America for environmental and energy law. She has also held leadership roles in the Idaho State Bar’s Environment and Natural Resources Section and served on the Idaho Environmental Forum’s board of directors.
