David W. Brody

David W. Brody represents financial institutions and commercial clients throughout California. With more than 36 years of experience, he advises banks of varying sizes on complex loan transactions, loan documentation, and disputes involving breach of contract, fraud, bankruptcy, and real estate. His practice combines transactional guidance with litigation experience, helping lenders protect their interests, address defaults, and respond to difficult commercial and financial challenges.

Brody earned his Juris Doctor from the University of San Diego School of Law in 1983. He previously earned a Bachelor of Science in Economics from Southern Connecticut State University in 1979. His legal education and economics background provide a strong foundation for evaluating lending relationships, financial risks, and commercial disputes. This training supports his practical approach to loan structuring, creditor rights, bankruptcy proceedings, and real estate-related matters.

Brody’s experience includes guiding lenders through workouts, restructurings, bankruptcies, and business sales involving California fast-food franchise owners. Brody has also pursued the appointment of receivers over apartment complexes, manufacturing facilities, real estate portfolios, and other commercial properties. In addition, he has opposed and restructured proposed Chapter 11 plans affecting secured and unsecured creditor rights and negotiated forbearance agreements involving commercial loan defaults.

David W. Brody is admitted in all California state courts and the federal district courts for the Southern, Northern, Eastern, and Central Districts of California. He is a former president of the San Diego County Bankruptcy Forum and has held leadership roles with the California Bankruptcy Forum and the Commercial Law Section of the San Diego County Bar Association. He has also delivered educational presentations for legal organizations and devoted 19 years of board service to two San Diego nonprofit organizations.
