Brian McGraw

Brian McGraw is a Principal Partner at Gray Ice Higdon and a seasoned intellectual property and commercial litigator. He focuses on resolving complex, high-value disputes, including patent, trademark, copyright, and trade secret litigation, often in “bet-the-company” scenarios. Brian represents clients ranging from Fortune 10 corporations to entrepreneurs and creators.

Brian holds a J.D. and an LL.M. in Intellectual Property from The John Marshall Law School, as well as a B.A. in Political Science from Miami University. His academic background and early experience in trademark prosecution and IP transactions provide him with a comprehensive, business-oriented legal approach.

Brian’s litigation practice spans technologies and industries—from farming equipment to hydrofoil surfboards. His recent victories include an $11 million patent verdict in Illinois and a $1.3 million IP judgment in Delaware. He also successfully defended a $90 million trademark case in the U.S. inland river cruising sector.

Beyond the courtroom, Brian counsels clients on contract disputes, brand strategy and development, IP licensing, and a wide range of commercial transactions. Known for turning complex legal and technical issues into clear, actionable guidance, he communicates effectively with judges, juries, and business stakeholders alike. Brian McGraw is admitted to multiple state and federal courts, including the Fifth, Sixth, and Federal Circuit Courts of Appeals.
