About
Brian Aust is a partner at Aust Schmiechen in Minneapolis who has represented immigrants and their families for more than two decades. His practice includes family-based immigration matters, marriage and fiancé petitions, asylum, naturalization, consular issues, and other immigration cases. He also appears in federal immigration-related proceedings and is admitted before the US Court of Appeals for the Eighth Circuit and the US District Court for the District of Minnesota.
Brian earned his J.D. from Hamline University School of Law. His legal education, combined with earlier work connected to refugee resettlement and immigrant advocacy, supports a practice focused on federal immigration statutes, agency procedures, documentary requirements, and courtroom advocacy. He is fluent in Spanish, which supports direct communication with many clients navigating family and humanitarian immigration processes.
Brian works on a broad range of immigration matters and has represented individuals seeking permanent residence through family relationships, asylum protection, and naturalization. Before forming his current partnership, he operated his own practice for more than five years. He is active with the Minnesota/Dakotas Chapter of the American Immigration Lawyers Association, where he mentors other attorneys on consular and family-based immigration issues and participates in continuing legal education programs.
Brian Aust combines long-term immigration practice with mentoring and community service. He has volunteered with The Advocates for Human Rights and has worked with organizations serving immigrants and asylum seekers. His experience helps clients address procedural requirements, family petitions, protection claims, and federal immigration disputes while receiving practical guidance from an attorney familiar with agency practice, court proceedings, and the human consequences of immigration decisions.
