Benjamin Herbst

Benjamin Herbst is the founder and managing partner of The Herbst Firm in Baltimore, Maryland, where his practice focuses on criminal defense and civil trial law. Herbst represents adults and juveniles facing misdemeanor and felony charges, including DUI, drug offenses, firearm crimes, assault, robbery, burglary, sex offenses, and other serious allegations. He also handles criminal and traffic appeals and federal criminal matters, helping clients evaluate defenses and prepare for hearings, motions, and trial.

Herbst earned his J.D. from the University of Miami School of Law after receiving a B.A. in Political Science with university honors from the University of Michigan. During law school, he worked as a certified intern with the Miami-Dade Public Defender and participated in felony trials. That early courtroom training provided a foundation for his later work handling criminal cases, evidentiary disputes, suppression issues, and trial strategy in both public defense and private practice.

After law school, Herbst served as an assistant public defender and represented close to 1,000 clients in matters ranging from theft and drug possession to armed robbery and carjacking. He later moved into private practice and has represented clients in more than 60 jury trials. His experience includes acquittals in DUI, drug, assault, and firearm cases, hundreds of pretrial motions, and appellate advocacy, giving him substantial experience across multiple stages of criminal proceedings.

Benjamin Herbst was selected to Maryland Super Lawyers in 2025 and 2026 and has been named among The National Trial Lawyers Top 100 Criminal Defense Lawyers in Maryland from 2015 through 2026. He has also appeared as a legal analyst on national and local television. Herbst is admitted in Maryland and Florida and before the U.S. District Court for the District of Maryland, supporting his state and federal criminal defense practice.
