Avece M. Higbee

Avece M. Higbee is a shareholder and the current president of Marquis Aurbach, where she leads a respected legal practice focused on real estate, common interest communities, and commercial landlord matters. With over three decades of legal experience, Ms. Higbee advises clients on a broad range of real estate transactions and disputes. Her practice includes guiding homeowners associations, property managers, commercial landlords, and SBA lenders through regulatory compliance, leasing issues, evictions, and real estate closings.

Ms. Higbee earned her J.D. from Brigham Young University’s J. Reuben Clark Law School in 1988. She holds a B.S., magna cum laude, from South Utah State (1985) with majors in English, Business Administration, and Dance.

Ms. Higbee’s deep experience in transactional and litigation matters makes her a go-to advisor for community associations and commercial real estate clients. She provides counsel on CC&Rs, bylaws, leasing terms, and enforcement procedures. Her knowledge extends to SBA loan closings, eviction disputes, and compliance for property owners and managers. She also actively contributes to legislative review as a member of the State Bar of Nevada’s Real Property Section’s Common-Interest Community Committee.

In addition to her advisory role, Ms. Higbee has authored numerous publications on landlord/tenant issues, commercial association governance, and real estate legislation. She is also a frequent lecturer for professional organizations across Nevada.

Admitted to Nevada in 1989, Ms. Higbee also practices before the U.S. District Court and Ninth Circuit Court of Appeals.
