Wayne Barsky

Wayne Barsky is a partner at Gibson, Dunn & Crutcher, where he has led high-stakes patent litigation and appeals for clients in the life sciences, pharmaceutical, and technology industries. For over 20 years, he co-chaired the firm’s Intellectual Property Practice Group, representing clients in more than 100 patent infringement cases. With extensive trial and appellate experience, he has successfully litigated in federal courts nationwide and before the U.S. International Trade Commission, securing precedent-setting victories in complex IP disputes.

Mr. Barsky earned his Juris Doctor from the University of California, Berkeley, in 1983 after completing his Bachelor of Arts at the State University of New York, Binghamton, in 1979. He is admitted to the California Bar and consistently recognized for his legal excellence. Publications such as IAM Patent 1000, Managing IP Handbook, Benchmark Litigation, and Best Lawyers in America have honored him for his achievements in intellectual property law. Chambers & Partners has ranked him as a top-tier patent litigator, and he was named General Patent Litigator of the Year by LMG Life Sciences in 2021.

One of Mr. Barsky’s most notable victories was leading the Gibson Dunn team in a decade-long biologics case, successfully defending Pfizer and Merck-Serono against Biogen’s $5.4 billion infringement claim. His practice spans cases involving pharmaceuticals, medical devices, biotechnology, software, and internet-based technologies. He has represented industry leaders such as Amgen, Medtronic, Johnson & Johnson, and Electronic Arts in high-profile patent disputes, including ANDA litigation, trade secret cases, and ITC investigations.

Beyond litigation, Wayne Barsky is deeply involved in community and pro bono work. He has served as Chairperson of the Public Counsel Law Center and is on the Board of the American Jewish Committee. He has also taught as an adjunct faculty member at USC Gould School of Law and has held leadership roles with the USC IP Institute and the Association of Business Trial Lawyers.
