Todd Werner is a partner and founder at Avantech Law, LLP, where his practice focuses on patent lawsuits and disputes involving competitors. He has represented pharmaceutical companies in ANDA litigation for about two decades. His work extends to patent disputes in life sciences, electrical, mechanical, and chemical technologies. He advises clients on contested proceedings, intellectual property licensing, joint development agreements, SaaS agreements, and patent portfolio monetization.
Todd earned a B.S. in Biochemistry, summa cum laude, from Michigan Technological University. He later received his J.D., cum laude, from the University of Minnesota Law School. His scientific training supports his work on pharmaceutical, biotechnology, chemical, and other technically complex patent matters.
Todd has handled significant patent litigation and post-grant proceedings for pharmaceutical and technology clients. He helped Hetero Labs invalidate a patent covering Biogen’s Tecfidera product for multiple sclerosis. He represented Teva Pharmaceuticals in disputes involving abuse-deterrent opioid formulations and other pharmaceutical patents. In another matter, he helped invalidate 114 of 117 challenged patent claims in inter partes review proceedings. The related federal litigation produced an attorney-fee award of about $1.4 million. His work includes district court litigation, Federal Circuit appeals, Patent Trial and Appeal Board proceedings, and negotiated settlements.
Todd Werner is admitted before the Minnesota Supreme Court, U.S. District Court for the District of Minnesota, and U.S. Court of Appeals for the Federal Circuit. His recognition includes Best Lawyers, Minnesota Super Lawyers, and Patexia rankings for ANDA litigation. He has represented military veterans through the Veterans Consortium Pro Bono Program. He has taught Intellectual Property Moot Court at the University of Minnesota Law School.
