Tara M. Smalstig

Tara M. Smalstig is a Partner who concentrates her practice in family law, estate planning, probate, and business matters. She represents individuals and families in divorce, property division, child custody and visitation, spousal maintenance, post-divorce issues, premarital agreements, paternity actions, adoptions, and guardianships. She works closely with clients to provide clear guidance during challenging and emotional transitions.

Tara earned her B.A. in 1998 from the University of Tennessee before receiving her J.D. in 2003 from Indiana University School of Law. She was first admitted to practice law in 2003. She is admitted in Indiana and before the U.S. District Court for the Southern District of Indiana and the U.S. District Court for the Northern District of Indiana.

In addition to family law, Tara advises business clients on business counsel, contracts, and business structuring and entity selection. Her estate planning services include drafting wills and trusts, revocable living trusts, irrevocable trusts, charitable planning tools, general durable power of attorney documents, health care representative designations, living wills, and comprehensive probate and estate administration services.

Tara has completed 40 hours of Civil Mediation Training and 40 hours of crossover Family Mediation Training, strengthening her ability to resolve disputes efficiently. She is active in the Muncie Bar Association, Indiana State Bar Association, Family Law Section, and the East Central Indiana Estate Planning Council. She also serves her community through leadership roles with local nonprofit and civic organizations.

Tara M. Smalstig has been honored with awards, including Muncie Area’s Finest Attorney in 2017 and 2018 and the Delaware County Personal Integrity Award in 2017, reflecting her commitment to professional excellence and community service.
