Joe Duncan is a trial and appellate attorney whose practice centers on defending complex civil claims for businesses ranging from family-owned companies to Fortune 500 organizations. His experience spans personal injury, product liability, construction defect, contractual disputes, trucking matters, and insurance coverage issues. In addition to handling litigation, he works closely with clients, contractors, and industry groups to identify potential risks and develop strategies aimed at reducing future liability exposure.
Joe earned his undergraduate degree from Auburn University in 2000, graduating cum laude. He then earned his juris doctor from the University of Alabama School of Law in 2003. During law school, he served on the Alabama Law Review and held the role of Senior Articles Editor from 2002 to 2003.
Joe’s professional involvement includes service with the Executive Committee for the School of Construction, CLM Claims College, and memberships in the Alabama Bar Association, Birmingham Bar Association, Claims and Litigation Management Alliance, and Alabama Defense Lawyers Association. He also holds CLM designations, including Certified Claims Professional (CCP), Advanced Claims Professional (ACP), and Certified Litigation Management Professional (CLMP).
Joe has played a meaningful role in shaping legal developments in Alabama through both legislative and judicial work. He assisted in the drafting of legislation involving contractor liability, contractor licensing, road builder liability, and statutes of repose. His advocacy before the Alabama Supreme Court has addressed significant issues involving indemnity, personal injury, and product liability. In Hosea Weaver and Sons, Inc. v. Balch, arguments presented on behalf of the Alabama Road Builders Association contributed to the Court’s recognition of the accepted-work doctrine, resulting in the reversal of a $7.5 million verdict. He also successfully argued DISA Industries, Inc. v. Bell, where the Court reversed a $500,000 plaintiff verdict and entered judgment for the defendant manufacturer.
Joe Duncan’s legal accomplishments have earned recognition from respected industry organizations. Honors include an AV-rated designation from Martindale Hubbell, selection to Mid-South Super Lawyers© from 2019 to the present, Mid-South Super Lawyers© Rising Star recognition from 2015 through 2018, Alabama Rising Star© recognition from 2013 through 2015, and inclusion in Best Lawyers In America© for Construction Law, Litigation – Construction, Litigation – Insurance, and Personal Injury Litigation – Defendants from 2023 to the present.
