James A. Overcash

James A. Overcash is an attorney at Woods Aitken who represents clients in construction, bankruptcy, commercial litigation, regulatory, and business matters. Working from the firm’s Nebraska and Colorado offices, he advises contractors, subcontractors, suppliers, manufacturers, design professionals, sureties, and financial institutions. His practice combines legal analysis with practical knowledge of construction projects, financial concerns, and business operations, helping clients address contracts, disputes, insolvency issues, and other complex commercial challenges.

James earned his B.S. from the University of Nebraska and his J.D. from the University of Nebraska College of Law. He is admitted to practice in Colorado and Nebraska, before the U.S. District Court for the District of Nebraska, and before the U.S. Courts of Appeals for the Fourth and Eighth Circuits. His legal education and industry background support a practical approach to bankruptcy, construction, and commercial matters.

James first practiced with Woods Aitken from 1987 to 1992, focusing on construction law, bankruptcy, and commercial litigation. He then spent a decade serving as general counsel and chief financial officer in the construction industry before rejoining the firm in 2002. He regularly serves as a Chapter 7 Panel Bankruptcy Trustee, formerly served as a Chapter 12 Trustee, and has handled matters as a Chapter 11 Trustee. His construction experience includes contract formation, negotiation, project management, and dispute resolution.
