H. Dill Battle III is a member at Spilman Thomas & Battle, PLLC in Charleston, West Virginia. He chairs the firm’s Workers’ Compensation Practice Group and Insurance Government Relations & Regulatory Practice Group. His primary practice covers workers’ compensation, employment relations and counseling, product liability litigation, and commercial lawsuits and disputes. He defends employers in workplace injury and occupational disease claims while advising businesses on employment matters and representing clients in complex disputes.
Mr. Battle earned a B.A. from the University of Virginia and a J.D. from West Virginia University. His education established the foundation for a practice involving employment issues, workplace injuries, regulatory concerns, and litigation. He is admitted in West Virginia and Virginia, as well as before the US Supreme Court, the Fourth Circuit, federal courts in West Virginia, and the US District Court for the Western District of Virginia.
Mr. Battle defends employers in workers’ compensation claims involving workplace injuries, occupational disease, occupational pneumoconiosis, and hearing loss. He advises employers on leave policies and other workplace matters and defends discrimination claims involving age, gender, race, disability, and harassment. His litigation experience extends to deliberate intent, toxic tort, product liability, premises liability, and medical malpractice defense. He represents financial institutions and loan servicers in disputes involving banking laws, consumer credit, TILA, and Regulation Z.
H. Dill Battle III is a Fellow and board member of the College of Workers’ Compensation Lawyers. He was named the 2020 Best Lawyers “Lawyer of the Year” for Workers’ Compensation Law – Employers in Charleston and holds an AV Preeminent peer-review rating from Martindale-Hubbell. His professional service includes workers’ compensation organizations and committees, while his community involvement includes leadership with HospiceCare and Rotary organizations. His experience combines employer counseling, regulatory knowledge, litigation, and workers’ compensation defense.
