About
Ericka F. Johnson is a director at Bayard, P.A. and chair of the firm’s business bankruptcy and restructuring practice. She advises companies and creditors on in-court and out-of-court restructurings, dissolutions, and strategies designed to maximize asset value and recoveries. She also helps buyers acquire distressed assets and counsels directors and officers on fiduciary duties in insolvency settings. Her practice serves debtors, creditors’ committees, trustees, governmental units, and other restructuring participants.
Ericka earned a J.D. from Delaware Law School, formerly Widener School of Law, and a B.A. from the University of Delaware. In law school, she served as president of the Moot Court Honor Society, participated in the Delaware Journal of Corporate Law, and received an Outstanding Service Award. Her prior work with a bank holding company also gave her business and risk-management experience that now informs her approach to bankruptcy strategy and financial restructuring.
Ericka represents debtors in chapter 11 and chapter 7 cases and regularly litigates contested bankruptcy matters. Her experience includes involuntary bankruptcies, trustee-appointment motions, claim objections, plan confirmation disputes, dismissal and conversion motions, preferences, fraudulent transfers, turnover actions, and breach of contract and fiduciary duty claims. She combines litigation with transactional restructuring advice, helping clients evaluate business options, insolvency risks, distressed acquisitions, and the legal consequences of major financial decisions.
Ericka F. Johnson has been recognized by Chambers USA for Bankruptcy/Restructuring in Delaware and by Best Lawyers, Lawdragon, Delaware Super Lawyers, and Delaware Today. She holds leadership roles with the American Bankruptcy Institute and the International Women’s Insolvency and Restructuring Confederation. Her practice combines bankruptcy litigation, restructuring strategy, distressed transactions, and professional leadership, giving clients experienced guidance through complicated insolvency matters and competing stakeholder interests.
