Eric Garcia is an experienced commercial litigator with a strong background in complex civil and commercial litigation in New York State, Federal, and Appellate Courts. He represents clients in alternative dispute resolution (ADR) forums, including arbitrations and mediations, working to resolve real estate, construction, and general commercial disputes. His practice includes advising condominium boards and unit owners on corporate governance, board elections, by-law enforcement, and alteration agreements for residential and commercial buildings.
Eric earned his B.A. from Emory University before obtaining his J.D. from St. John’s University School of Law. He is admitted to practice in New York State, as well as the United States District Courts for the Southern and Eastern Districts of New York and the United States Court of Appeals for the Second Circuit.
Eric regularly prosecutes and defends commercial leasing disputes, including negotiating surrender agreements and representing clients in New York City’s Commercial Civil Courts (Part 52). He also appears before New York City agency tribunals, handling civil and criminal violations involving the Environmental Control Board (ECB), Department of Buildings (DOB), New York City Commission on Human Rights, and the FDNY SAP-2A.
Partnering with the firm’s real estate tax-incentive team, Eric has successfully secured Article 78 judgments against New York City agencies, enabling developer clients to recover millions of dollars in anticipated real estate tax benefits.
