Emily Smith

Emily Smith is a criminal defense attorney at Moermond & Mulligan, LLC, who represents clients facing traffic offenses, misdemeanors, felony charges, and family defense matters involving Children’s Services. Emily earned a B.A. in Criminal Justice and Sociology from Wright State University and a J.D. from the University of Dayton School of Law. During law school, she served as a Dean’s Fellow and received the McGreal Dean’s Fellowship Award and the Outstanding Dean’s Fellow in Law honor. Her academic background, combined with years of legal support and courtroom experience before becoming an attorney, provides a strong foundation for evaluating criminal charges, understanding court procedures, and developing defense strategies.

Emily began her legal career path as a 911 dispatcher with the Montgomery County Sheriff’s Department before moving into legal support work as a legal secretary, in-court assistant, and criminal and family law paralegal. After law school, she worked as a public defender with the Montgomery County Public Defender’s Office. She later became a prosecuting attorney with the Montgomery County Prosecutor’s Office, serving in the child protective unit, grand jury division, and felony criminal division. Her experience as both a public defender and prosecutor gives her insight into how criminal cases are investigated, charged, and litigated.

Emily Smith is admitted to Ohio state courts and the US District Court for the Southern District of Ohio. She belongs to the Dayton Bar Association, Ohio Bar Association, Ohio Association of Criminal Defense Lawyers, and National Association of Criminal Defense Lawyers. Her courtroom results include not-guilty verdicts in rape, gross sexual imposition, and domestic violence cases, along with dismissals involving sexual battery, theft, domestic violence, and assault charges.
