Derek A. Huish

Derek A. Huish is an associate in Ballard Spahr’s national Litigation Department in Salt Lake City. Derek focuses on commercial litigation and dispute resolution. Before joining the firm, he worked at a Chambers-ranked multinational law firm on complex commercial cases, particularly intellectual property litigation and damages-related issues. His experience includes work through multiple stages of litigation, including jury trials, giving him a foundation for handling demanding business and patent disputes.

Derek earned a J.D. with high distinction from the University of Iowa College of Law in 2019 and a B.S. from Brigham Young University in 2016. In law school, he served as Senior Managing Editor and Student Writer for the Iowa Law Review, participated on the National Moot Court Competition Team, and worked in legal clinic programs involving employment law and community empowerment law. He is admitted in Utah and Iowa.

Derek’s representative work includes design patent litigation involving a camera company, vehicle patent litigation involving discovery and damages evidence, and patent cases concerning OLED technologies, plant-based meat alternatives, cybersecurity technology, and medical supply products. He works for multinational manufacturers, technology businesses, and other clients in complex intellectual property disputes. These matters involve detailed discovery, motions, technical evidence, and significant damages questions.

Derek A. Huish also brings three years of federal judicial clerkship experience to his commercial litigation practice. Derek clerked for Judge Leonard T. Strand in the US District Court for the Northern District of Iowa from 2019 to 2021 and Judge David B. Barlow in the US District Court for the District of Utah from 2021 to 2022. His background supports careful research, writing, discovery management, and trial preparation in complex commercial and patent litigation.
