David E. Runck is a shareholder at Fafinski Mark & Johnson, P.A. and chair of the firm’s Bankruptcy & Insolvency group. He represents creditors and other clients in distressed-loan matters, bankruptcy cases, loan-default litigation, mortgage foreclosures, receiverships, debt restructurings, and workout negotiations. His practice also includes civil litigation in state and federal courts, with work involving banking, real estate, appellate issues, and commercial disputes.
Runck earned his J.D. from Boston University School of Law in 1996, where he served as an editor of the Annual Review of Banking Law. He received his B.A., cum laude, from Brandeis University in 1993. His background in education and banking law supports his ability to analyze creditor rights, evaluate risk in distressed transactions, and guide clients through litigation and insolvency matters with practical judgment.
Runck has extensive experience representing banks, secured and unsecured lenders, creditors’ committees, indenture trustees, bondholders, landlords, and equipment finance and leasing companies. He has served as counsel in Chapter 11 cases, workouts, receiverships, fraudulent transfer and preference disputes, lien priority matters, and distressed real estate sales. Before joining FMJ, he was a Vice President at Wells Fargo Bank, N.A., and previously practiced in a large Minneapolis law firm.
David E. Runck has been named a Minnesota Super Lawyer since 2011 and has argued appeals before the Eighth Circuit, the Eighth Circuit Bankruptcy Appellate Panel, and the Minnesota Court of Appeals. He also served as a law clerk for Judge Nancy C. Dreher of the US Bankruptcy Court for the District of Minnesota and the Eighth Circuit BAP.
