David M. Posner is a Partner and Vice Chair of the Bankruptcy & Restructuring Department at Lowenstein Sandler LLP. With over 25 years of experience, he represents creditors’ committees, financial institutions, and distressed companies in complex reorganizations and high-stakes bankruptcy matters across the nation.
David earned his Juris Doctor, cum laude, from Syracuse University College of Law in 1988. He holds a Bachelor of Arts, magna cum laude, from Syracuse University and is admitted to practice in New York and several U.S. appellate and district courts, including the Second and Third Circuits.
David has led numerous Chapter 11 matters involving liabilities exceeding $100 million across various industries, including retail, hospitality, aviation, and manufacturing. His notable engagements include representing creditors in the bankruptcies of Nine West, Gold’s Gym, Reader’s Digest, and Sbarro, as well as in recent cases involving Leafly, Hearthside Food Solutions, and One Table Restaurant Brands.
David’s litigation background complements his restructuring work. He has successfully handled trials in federal, state, and bankruptcy courts and is highly experienced in bankruptcy appellate litigation, judgment enforcement, and commercial disputes related to debtor-creditor relationships.
Recognized by Best Lawyers in America, Chambers USA, and Super Lawyers, David has been honored for his leadership in both bankruptcy litigation and restructuring law. He also received the Turnaround Management Association’s Large Company Turnaround Award in 2020.
David maintains active memberships with the American Bankruptcy Institute, Turnaround Management Association, and American Bar Association. He has also served as co-chair of the ABI’s Unsecured Trade Creditors Committee, highlighting his influence within the national bankruptcy community.
