David H. Ben-Asher is a New Jersey employment lawyer and partner who has represented employees exclusively for decades. He handles discrimination, harassment, whistleblower retaliation, wrongful termination, employment contract, family and medical leave, and equal pay claims. He also advises employees during severance negotiations and serves as a qualified mediator for private and court-ordered employment disputes. Ben-Asher earned his J.D. from Georgetown University Law Center. He is admitted in New Jersey, the US District Court for the District of New Jersey, the Third Circuit, and the US Supreme Court. Ben-Asher has argued or tried cases at every court level in the jurisdiction, including the US Supreme Court. He drafted provisions of the New Jersey Law Against Discrimination prohibiting sex and disability discrimination and handled early cases interpreting those protections. Earlier, he served as a New Jersey Deputy Attorney General and Chief Counsel to the state Division on Civil Rights. He later worked as a discrimination hearing examiner, Essex County Counsel, and litigation director for the New Jersey Department of the Public Advocate.
David H. Ben-Asher serves on the Executive Committee of the New Jersey State Bar Association’s Labor and Employment Law Section.
