Brian P. Muething

Brian P. Muething is a partner at KMK Law who assists clients with complex legal issues and represents them in litigation. His practice includes defense of ERISA fiduciary duty and ESOP-related claims, as well as defense of state-law breach-of-fiduciary-duty claims against officers and directors.

Brian earned a J.D. from Donald P. Klekamp College of Law at the University of Cincinnati in 2003. He also earned a B.A. from Miami University in 2000, with a triple major in political science, geography, and urban and regional planning, supporting his litigation and business counsel.

Brian serves as principal outside counsel to FC Cincinnati. Manufacturing companies and the franchisee of a national restaurant also seek his counsel on general legal matters. His work covers litigation, workouts and restructuring, commercial and securities litigation, creditors’ rights litigation, employment litigation, workers’ compensation, class action litigation, and sports and entertainment matters.

Brian has represented officers, directors, corporations, private companies, and financial institutions in major disputes. His work includes fiduciary duty litigation, ERISA claims, class actions, commercial disputes, environmental matters, overbilling claims, mutual fund conflict claims, summary judgment matters, appeals, and case dismissals before courts, including decisions affirmed by the Sixth Circuit.

Brian has been listed in The Best Lawyers in America, 2026, and named to Ohio Rising Stars. These honors reflect his litigation practice and professional recognition. He is admitted in Ohio, several U.S. Courts of Appeals, and the U.S. District Court for the Southern and Northern Districts of Ohio.

Brian P. Muething also teaches at the Lindner College of Business at the University of Cincinnati. He previously taught business law at Miami University’s Farmer School of Business and Xavier University’s Williams School of Business.
