Kyle W. Nelson is a partner and trial lawyer in Bozeman, Montana. He represents plaintiffs and defendants in commercial litigation, business tort claims, corporate and shareholder disputes, personal injury cases, and property and easement matters. His practice also includes disputes over access to public land, rivers, and lakes. In bankruptcy proceedings, he works on asset recovery for trustees and the protection of creditors’ rights.
Kyle earned a B.A., cum laude, from the University of Montana in 2006, followed by a J.D. from the University of Montana in 2009. In law school, he served as Editor-in-Chief of the Public Land & Resources Law Review. Before pursuing his degrees, he served in the U.S. Marine Corps infantry and received an honorable discharge in 2002. He also spent summers working for the U.S. Forest Service, fighting fires and surveying timber.
Kyle began his legal career at a commercial firm in Bozeman, where he handled complex cases involving medical malpractice, toxic torts, natural gas explosions, and environmental issues. His trial experience includes representing a construction company in a contract termination and fraud case that resulted in a verdict exceeding $4 million. He has also defended a ranch management and succession contract case, obtaining a verdict in favor of the defendants on all claims, and represented a Chapter 7 trustee in litigation to recover estate property.
Kyle W. Nelson is admitted to practice in the state and federal courts of Montana and Wyoming and before the U.S. Court of Appeals for the Ninth Circuit. He belongs to both states’ bar associations. He also serves on the Montana Justice Foundation Board, the Montana Supreme Court Access to Justice Commission, and the Gallatin County Bar Association Board. His work spans trial and appellate matters involving businesses, property rights, public access, and bankruptcy.
