About
Kelsey M. Hayes is a partner at Burr & Forman in Washington, DC, whose practice focuses on government contracts, construction, and project development. Kelsey represents contractors in bid protests, claims, and disputes before the U.S. Government Accountability Office, Boards of Contract Appeals, federal agencies, and the U.S. Court of Federal Claims. She also advises clients on federal procurement rules, small business contracting programs, compliance obligations, and strategies for reducing contracting risk.
Kelsey earned a J.D. from The George Washington University Law School and a B.S. from Virginia Commonwealth University. In law school, she served as editor-in-chief of the Public Contract Law Journal. Before practicing law, she worked as a project controller for a Service-Disabled Veteran-Owned Small Business and later served as a law clerk with the General Services Administration’s Office of Government-wide Policy in the Suspension and Debarment Division.
Her experience includes pursuing and defending bid protests, preparing requests for equitable adjustment, termination settlement proposals, and Contract Disputes Act claims, and challenging negative contractor performance assessments. Kelsey also counsels clients on suspension and debarment, False Claims Act and procurement integrity investigations, federal small business programs, technical data and software rights, Truthful Cost or Pricing Data requirements, and Cost Accounting Standards. She has represented companies responding to subpoenas, civil investigative demands, and compliance concerns.
Kelsey M. Hayes combines litigation experience with practical knowledge of federal contracting operations and small business programs. Kelsey has also worked with public utilities on federal energy service agreements and advises contractors on preserving rights while maintaining productive agency relationships. Her work helps government contractors understand procurement rules, address disputes, protect business interests, and build compliance systems suited to the demands of the federal marketplace.
