About
K. Brett Marston is the managing partner of Gentry Locke and an experienced Virginia construction, dispute resolution, and OSHA lawyer. He represents general contractors, subcontractors, owners, design professionals, suppliers, and other businesses in construction contracts, payment disputes, mechanic’s liens, bond claims, defect cases, delay claims, insurance issues, and workplace safety matters. Marston also serves as a mediator and arbitrator in commercial disputes, particularly those connected to construction projects.
Marston earned his J.D. with distinction from George Mason University School of Law and his B.A. from the University of Virginia. During law school, he served on the George Mason University Law Review. He later clerked for the Honorable J. Calvit Clarke, Jr., a senior judge of the U.S. District Court for the Eastern District of Virginia. His education and federal clerkship strengthened the research, analysis, and advocacy skills that support his litigation and dispute resolution practice.
Marston represents clients in federal and state courts, mediation, arbitration, and administrative proceedings. His experience includes disputes involving major hotel, stadium, power plant, roadway, utility, hospital, and municipal projects. He has handled multimillion-dollar claims concerning termination, construction defects, design errors, payment, change orders, delay damages, surety obligations, and contract interpretation. Marston also defends employers against OSHA citations, including serious, repeat, and willful violations, and assists contractors with bid protests and government contracting matters.
K. Brett Marston served as the 87th president of the Virginia State Bar and is its immediate past president. He has been recognized by Chambers USA for construction law and by The Best Lawyers in America for construction law and construction litigation, including multiple Roanoke Lawyer of the Year honors. He is also a Fellow of the Virginia Law Foundation. By combining industry knowledge, courtroom experience, and practical judgment, Marston helps construction clients manage risk and resolve complex disputes.
