Brent Bastian

Brent Bastian is a shareholder at Kirton McConkie in Boise and a member of the firm’s Litigation section. His practice includes business torts, contract claims, premises liability, sexual-abuse litigation, agricultural law, and other complex commercial disputes. He also advises organizations before litigation arises, drawing on both private-practice and in-house experience to provide legal guidance that business leaders can understand and use in operational decision-making.

Bastian earned a J.D. magna cum laude from Tulane University Law School, where he served as Senior Justice of the Tulane Moot Court Board and received the Van Horn Scholarship for Outstanding 3L. He earned a B.A. in Political Science, cum laude, from Boise State University. His academic and advocacy background supports a litigation practice that requires close analysis of contracts, business relationships, evidentiary records, and trial strategy.

His representative experience includes a partnership action against a large hospital that resulted in a substantial award after an eight-week trial and later appellate proceedings. In another matter, he persuaded a bankruptcy court after trial to reduce a major damages award against a client. Bastian has also counseled The Church of Jesus Christ of Latter-day Saints in Idaho matters and previously worked in-house for a large Idaho company while continuing to litigate.

Brent Bastian is recognized as a Senior Fellow of the Litigation Counsel of America and has previously been listed by Mountain States Super Lawyers and Rising Stars. His practice combines courtroom experience with an understanding of internal business pressures, allowing him to advise companies and organizations on litigation strategy, risk, and practical responses before and after disputes develop.
