Bernstein, Robert S.

Robert S. Bernstein is a partner in Holland & Knight’s New York office and a member of its Construction Industry Practice Group. He advises on heavy construction, infrastructure, and significant real estate development projects in the United States and internationally. His practice includes construction contracts, project counseling, and litigation involving development disputes. He works on projects in sectors such as hospitality, transportation, and commercial real estate.

Bernstein earned his J.D. from Benjamin N. Cardozo School of Law and a B.S. from Cornell University. While in law school, he worked at the United States Attorney’s Office for the Southern District of New York and participated in the Moot Court Honor Society. This background supports a practice combining contractual analysis, dispute resolution, and legal advice during the development and construction of substantial projects.

His work includes defending a major design and construction defect claim, negotiating engineering, procurement, and construction contracts for a power generation project, and advising on data center development. Bernstein has worked on port, commuter rail, toll road, hotel, and museum expansion projects. He also has experience with international construction arbitration and transactions involving real estate while significant construction work remains underway.

Bernstein regularly speaks on construction issues and has received recognition in Chambers USA, The Legal 500 USA, and The Best Lawyers in America for construction-related work. He has also received pro bono recognition from Holland & Knight and Sanctuary for Families. Robert S.
