Benjamin Gerber

Benjamin Gerber is a founding attorney of Gerber & Elkins and an Atlanta workers’ compensation lawyer who represents people injured on the job. He has more than two decades of experience in Georgia workers’ compensation matters and has represented claimants since 2004. His practice focuses on helping injured workers pursue medical treatment, income benefits, and other compensation available under Georgia law while responding to disputes with employers and insurance carriers.

Benjamin graduated cum laude from the University of Georgia with a bachelor’s degree in political science and earned his J.D. from George Washington University Law School. During law school, he worked in the Consumer Affairs Clinic and completed legal internships with the Department of Justice and the US District Court for the District of Columbia. His education and early practical experience helped build a foundation in litigation, client advocacy, and public-interest legal work.

Benjamin began his career on the insurance defense side, spending several years learning how carriers evaluate claims, develop strategy, and decide when to contest benefits. He later moved to a plaintiffs’ practice handling workers’ compensation and personal injury matters before founding an Atlanta firm focused exclusively on Georgia workers’ compensation. His current work includes denied claims, serious workplace injuries, benefit disputes, negotiations with insurers, and litigation when contested issues cannot be resolved informally.

Benjamin Gerber has been selected to Georgia Super Lawyers and has held leadership roles in organizations focused on injured workers, including the Workers’ Injury Law & Advocacy Group. He also has served with Georgia workers’ compensation claimant organizations and the Atlanta Bar Association’s Workers’ Compensation Section. His practice combines defense-side insight with long-term claimant representation, helping injured employees understand the system, protect their rights, and pursue the benefits available after workplace injuries.
